How to Appeal Your Property Tax Assessment
07/17/2007

It is safe to assume everyone in DR took a significant hit in the property tax department with the issuance of the latest real property tax assessments issued by the Decatur Township Assessor. If you want to appeal your assessment, please read the following taken from the WTHR website

How to appeal your property tax bill
Contact the Decatur Township Assessor within 45 days of receiving your tax notice or bill. File Form 130 or write a letter detailing your argument to your township assessor. File a copy with the county assessor as well. The Property Tax Assessment Board of Appeals reviews the petitions and will send you its determination.

Keep in mind that an appeal may result in the Board of Appeals raising your home value, maintaining it or lowering the assessment.

Some township assessors are offering a simplified form to fill out if you go in person to their office. This may be your best course of action, but be sure to bring any recent appraisal of your home, a purchase agreement or closing statement or other documentation from your mortgage company that shows the assessed value of your home. Also, if there are any houses for sale in your neighborhood, bring that information with you to help make your case if you feel your assessment is over what your house is worth.

If you are not happy with the Board decision, your next step is to appeal to the state Board of Tax Review. You must do so within 30 days of receiving the assessment board decision. You will need a lawyer or state-certified tax representative.

Finally, you have another 45 days to file a request for review by the Indiana Tax Court if you do not like the decision made by the Board of Tax Review. File a copy of your appeal with the attorney general office and your county assessor.

A final appeal can be made to the state Supreme Court.

Architectural Review Committee
06/07/2007

Many homeowners in the neighborhood have taken it upon themselves to upgrade their home with landscaping, fencing, new colors, decks, etc... There is a process that must be followed to get approval before a project is done, or the Association has the right to have the homeowner put whatever changes they have made, back to its original state.

It does not take much time to fill out the review forms, send them in, and get approval before starting a project. If the homeowners allow this to happen and not stand rigid with the covenants, then we are opening ourselves up for future modifications of homes that are unsightly and, in turn, make the value of our homes go down.

If we stand strong, following the covenants, then we have a leg to stand on to fight unsightly modifications.
